March Term 1845

 

State of Tennessee, Benton County, March Term 1845

At a County Court began and held for the County of Benton at the Courthouse in the Town of Camden on the first Monday in March.  It being the 3rd day of said Month in the year of our Lord one thousand eight hundred & forty five and 67th year of Marican Independence there being present and presiding on the bench the worshipfuls, Esqrs. D.P. Hudson, Chairman Geo. W. Farmer, John W. Davidson.

The Clerk of this Court presented a settlement Made with Charles H. Thompson one of the Administrators of Wiggins Collier deceased which said settlement was examined and concurred in by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with C.K. Wyly, Treasurer of the board of Trustees of Benton County Academy which said settlement was examined and now concurred in by the Court.

On Motion it is ordered by the Court that Henry Hansel, William Mizell, Dennis Stockdale, William Stickdale, Charles Robins, Daniel Graham and John Moss be appointed a jury of Review to view and Mark an alteration in the road on this side of William Stockdale’s and running so as to have said Stockdale’s house on the opposite side

from where it now stands and thereto intersect said road on the other side of said Stockdale’s house and Make report to the Next term of this Court, of the advantages & disadvantages to the public & to individuals.

On Motion and it appearing to the satisfaction of the Court that execution has issued against A.C. Presson and his securities for his failing to pay over the County Revenue by him collected.  It is therefore ordered by the Court that such County Claims as may have been issued for the time for which said Collector and his securities May be liable shall be received as Money upon bids when offered upon property exposed to sale to satisfy such judgment.

March Term 1845.

On Motion of  Malcomb Beaton who Made oath according to law and together with him D. Graham and David Brewer his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of three hundred dollars conditioned as the law directs.  It is therefore ordered by the Court that he have letters of Administration upon the estate of Christopher Beaton deceased to be Made out in due form of law when required.

Personally appeared in open Court William J. Greer who was this day chosen and appointed guardian of Abraham Clement a Minor and together with him R.H. Hawthorn and E. Perkins his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of eight hundred dollars conditioned as the law directs.

On Motion it is ordered by the Court that John Baggett be appointed overseer of the road in room of Cullen Nowell to work from Ammons’ Branch to Flowers Mill, hands as follows - John Smith Sr., C. Novell Isiah Bright, Addison Nowell, Hiram Smith, Coleman Brewer, Alford Harris and John Prince and all other hands in the bounds shall work under said Baggett on said road which is established in the 2nd Class,

Personally appeared in open Court William Barnes, Esqr. Revenue Commissioner of the 3rd District, John D. Rushing, Esqr. Renvenue Com. of the 6th District & J.D. Hall, Esqr. Revenue Co, in the 9th District of said County who severly returned a list of Taxable property & polls in their respective districts for the year 1845 which was ordered by the Court to be recorded.

Personally appeared, in open Court D. Graham and R.M. Graham Administrators of the estate of John Graham deceased and returned a sale bill of the property of said estate and oath being Made to the same, it is ordered to be recorded.

March Term 1845

On Motion it is ordered by the Court that D.P. Husdon, J.W. Davidson, Geo. W. Farmer, J.R. Mathews, B. Beard and Thomas Floyd, revenue commissioners for Benton County be allowed until Next term of this Court to complete & return the tax list of these several districts.

Court then adjourned until Court in Course.

State of Tennessee, Benton County, April Term 1845

At a County Court began and held for the County of Benton at the Courthouse in the Town of Camden on the first Monday in April.  It being the 7th day of said month in the year of our Lord one thousand eight hundred and forty five and 69th year of American Independence.  There being present and presiding on the bench the worshipfuls, Esqrs., D.P. Hudson, E. Perkins, David W. Benton, H. Greer, Joseph R. Mathews, John W. Davidson, G.W. Farmer, J.D. Rushing, W.M. McAuley, B. Beard, Wm. Barnes, Thos. R. Jett, N. Williams.

Personally appeared in open Court Thomas R. Jett and produced a commission from his Excellency James C. Jones, Governor, Commissioning him a Justice of the peace for Benton County.  Thereupon the said Thomas R. Jett took an oath to support the Constitution of the United States and of the State of Tennessee, an oath against dueling and also the oath of office. Whereupon the said Thomas R. Jett took his seat upon the bench.

The Court then proceeded to Make an appropriation to Obediah Whittle and E.M. Cashion for burial expenses incurred in burying Elisha Yates who had been sent from this County to the Jail of Carroll County for safekeeping where the said Yates died, and there being present and presiding on the bench a Majority of all the Justices in Benton County and the vote being taken, those voting in the affirmative are Esqrs. D.P. Hudson, E, Perkins, Mathews, Beard, J.W. Davidson, McAuley and H. Greer - 7 – Those who voted in the Negative are Esqrs. J.D. Rushing, Farmer.
