July Term 1847

 

State of Tennessee, Benton County, July Term 1847

At a County Court began and held for the County of Benton at the Courthouse in the Town of Camden on the 1st Monday in July, it being the 5th day of said Month in the year of Our Lord One thousand eighteen hundred and forty seven and 72nd year of American Independence, their being present and presiding on the bench the worshipfuls, Esqrs, (to wit) Elijah Alsop, E. Perkins, Nathan Williams, David W. Benton, John W. Davidson, Jonathan K. Thomas, John C. McDaniel, Jesse D. Hall, D.P. Hudson, John D. Rushing, Geo. W. Farmer, Samuel H. Davidson.

Personally appeared in open Court A.W.C. Methany and Sarah Jackson Administrator and administratrix of the estate of Elisha Jackson deceased and returned an account of sale of the property and effects of said estate and oath being Made to the same it is ordered by the Court to be recorded.

The Court then proceed to Make an appropriation to Martha A. Graham for keeping William Rushing a pauper of said County from the first of October 1846 to the first of October 1847.  And there being present and presiding on the bench a Majority of all the Justices in Benton County and all them voting in the affirmative, it is ordered by the Court that the said Martha Graham be allowed and paid the sum of Twenty five dollars for keeping said pauper as aforesaid and that the Trustee of said County pay the sum out of any Money in the Treasury for the payment of paupers not otherwise appropriated.

Issued July 28th.

The Clerk of this Court presented the following settlement (to wit)

One Made with Presley Thorington guardian of Eliza Harrison, One Made with A.W.C. Metheny, administrator of the estate of James Daniel deceased, One Made with James Walker Administrator of the estate of George W. Barnett, deceased.  One Made with Jesse Hammonds executor of the last will and testament of Nancy Harrison, deceased.  One Made with Sarah Hatley guardian of the Minor heirs of Hardy Hatley deceased and One Made with C.H. Thompson administrator of the estate of Wiggins Colier deceased which said settlements were examined and approved by the Court and ordered to be recorded.

July Term 1847.

The Court then proceeded to Make an appropriation to Henry C. Camp for Making a coffin for William Collins deceased who was a pauper of said County and there being present and presiding on the bench a Majority of all the Justices in Benton County and a Majority voting in the affirmative.  It is therefore ordered by the Court that the said Camp be allowed and paid the sum of Three dollars for Making said Coffin and that the Trustee pay the same out of any Money in the Treasury for the payment of paupers not otherwise appropriated.

Personally appeared in open Court David W. Benton guardian of Mary J. Cotton and together with him Merritt Melton and John W. Davidson his securities who appeared in open Court and acknowledged the due execution of their bound in the penal sum of Two hundred dollars conditioned as the law directs.

Personally appeared in open Court Basil Rodgers Administrator of the estate of David Nisler deceased and returned a sale bill of said estate and oath being Made to the same it is ordered by the Court to be recorded.

The Court then reconsidered the settlement Made by the Revenue Commissioners with the Trustee so far as to show who is legally charged with the sum of $291.13 which appears to be charged as in the hands of the Sheriff for the year 1846.  When it is Not shown that there is any suit commenced by the Trustee for the same.

John D. Rushing and others who were appointed at a former term of this Court to lay off and set apart a sufficiency of provisions to serve the widow and family of David Nisler deceased Made report to this Court which is ordered by the Court to be recorded.

Personally appeared in open Court Joel Rushing guardian of Sarah Ann Rushing and together with him John W. Utley and Noah Rushing his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Sixteen hundred dollars conditioned as the law directs.

July Term 1847.

Personally appeared in open Court Age Hall guardian of the Minor heirs of Henry Hall deceased and together with him H.C. Camp and John Melton his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of One hundred dollars conditioned as the law directs.

The Court then proceeded to appoint Judges to hold the election in the various precincts in Benton County on the 5th day of August Next for the purpose of electing One Governor, a Member of Congress and one to the senate and one to the House of Representatives of the legislature of Tennessee.  Whereupon the following persons were appointed (viz.)

2nd Dist.            Green Flowers, Redden Hollowell and John Baggett.
3rd Dist.            I.B. Cox, Thomas Swindle and Pleasant Mullinix
4th Dist.            James Allen, John F. Johnson, Samuel B. Pearce
5th Dist.            James Arnold, Willis Rushing and Littlebury Williams
6th Dist.            J.J. Rodgers, John H. Williams and L.D. Pearce
7th Dist.            Berry Vester, Etheldred Melton and John Melton
8th Dist.            Lewis Brewer, Hyram Pearce and Alexander McRae
9th Dist.            Drew A. Askew, A.W.C. Matheny and William Wright

Issued July 6th

The Court then proceeded to Make an appropriation to Irvin B. Carns for extra work done on the Jail house and there being present and presiding on the bench a Majority of all the Justices in Benton County and all voting in the affirmative it is therefore ordered by the Court that the said Carns be allowed and paid the sum of forty four dollars by the commissioners of the Town of Camden out of any money in the Treasury for general County purposes not otherwise appropriated.

The Court than Made an appropriation to Anderson Lashlee for boarding the Yeates family while prisoners and guard and also the Jury and officials are there being present and presiding on the bench a Majority of all the Justices in Benton County and a Majority of them voting in the affirmative it is therefore ordered by the Court that the said Lashlee be allowed and paid the sum of Twenty eight dollars by the Trustee of said County out of any Money in the Treasury for general County purposes not otherwise appropriated.

July Term 1847.

The Court proceeded to Make an appropriation to Anderson Lashlee for boarding prisoners and guard in the case of the State vs. Fincher and there being present and presiding on the bench a Majority of all the Justices in Benton County and a Majority of them voting in the affirmative it is therefore ordered by the Court that the said Lashlee be allowed and paid the sum of Three dollars & 75 cents and that the Trustee pay the same out of any money in the Treasury for general County purposes not otherwise appropriated.

George W. Farmer, Wilie Arnold, John Davis, Berry Vester and David W. Benton who were appointed at a former term of this Court to view and Make a public road Made report to this Court which is as follows: We the undersigned freeholders having been summoned by the Sheriff of said County and duly sworn as a Jury of review to lay out the road as described in the within order do agree upon and Make the following report beginning at a point on the west bank of Tennessee River just below the Mouth of Cypress Creek in said County thence westward to the Pinehill hollow thence up said hollow ascending the hill on the west of the same so as to gain the Top of the ridge thence nearly as possible meandering said Ridge to where Wm. Cates now lives, thence a southern direction passing thru the lands of Esqrs. George and Albert C. Holt and others and to intersect the stage road from Jackson to Nashville passing thru Camden at Wyly Arnold’s plantation on said road they have then viewed out said road to the general advantage.  It is therefore considered by the Court the following Justices being present and presiding on the bench; E. Perkins, D.P. Hudson, E. Alsop, Geo. W. Farmer, John D. Rushing, S.H. Davidson, John C. McDaniel, John W. Davidson, David W. Benton, Nathans Williams, Jonathan K. Thomas, Jesse D. Hall, that Ray S. Orton have the privilege of opening a public road and highway of the first Class in pursuance of said report that he be appointed overseer of said road and that he open the same at his own expense and keep the same in repair with his own hands.  It is further ordered by the Court that said Ray S. Orton have the privilege of keeping a public ferry at or near the Mouth of Cypress Creek in said County and that he be allowed the same rates of ferrage that is allowed to the ferry keepers at Reynoldsburg.

July Term 1847

Personally appeared in open Court Amos Bruce guardian of the Minor heirs of Burrell Lashlee deceased and together with him Seth Utley and Henry C. Camp his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Two hundred dollars conditioned as the law directs.

The Court then proceeded to Make an appropriation to David Brewer Sheriff for guarding prisoners twelve days and there being present and presiding on the bench a Majority of all the Justices in said County and all voting in the affirmative.  It is therefore ordered by the Court that the said David Brewer be allowed and paid the sum of Twelve dollars by the Trustee out of any Money in the Treasury for general County purposes not otherwise appropriated.

Issued July 12th.

The Court then proceeded to Make an appropriation to David Brewer to pay five guards four days each and there being present and presiding on the bench a Majority of all the Justices in Benton County and all voting in the affirmative.  It is therefore ordered by the Court that the said Brewer be allowed and paid the sum of Fifteen dollars by the Trustee of Benton County out of any money in the Treasury for general County purposes not otherwise appropriated.

The Court then proceeded to Make an appropriation to Thomas L. Floyd who this day agrees to keep Henry Jordan a pauper of this County until July next for the sum of Thirty four dollars & 75 cents and there being present and presiding on the bench a Majority of all the Justices in Benton County and all voting in the affirmative.  It is therefore ordered by the Court that the said Floyd be allowed and paid the sum of Thirty four dollars and 75 cents out of any Money in the Treasury for the payment of paupers not otherwise appropriated.

Issued July 7th.

On Motion of A.W.C. Methany Administrator of the estate of Elisha Jackson deceased it is ordered by the Court that the ferry be established across Tennessee River for the benefit of said Jackson be henceforth discontinued, disannulled and for nothing held.

July Term 1847.

Personally appeared in open Court William Marchbanks and S.H. Davidson who was this day appointed guardian of Lettice Marchbanks and together with them John W. Davidson their securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Two hundred dollars conditioned as the law directs.

Court then adjourned until Court in Course.
