January Term 1846

 

State of Tennessee, Benton County, January Term 1846

At a County Court began and held for the County of Benton at the Courthouse in the Town of Camden on the first Monday in January, it being the 5th day of said Month in the year of our Lord one thousand eight hundred & forty six and 70th year of American Independence.  There being present and presiding the worshipfuls, Esqrs. (to wit) D.P. Hudson, J.K. Thomas, Wm. H. Smally, S.H. Davidson, J.D. Rushing, Geo. W. Farmer, Nathan Williams, J.W. Davidson, Thos. R. Jett, E. Perkins, William Barnes, Eligah Alsop and Wm. M. McAuley.

The Court first proceeded to elect a Chairman to preside over the deliberations of this Court for the year 1846 and after going into said election by ballot and the votes being counted it appears that E. Perkins is duly elected Chairman of this Court for the present year.

The Commissioners who were appointed at a former term of this Court to lay off and set apart a sufficiency of provisions to serve the widow and family of Charles Barnes deceased, one year Made report which was received by the Court and ordered to be recorded.

Personally appeared in open Court David E. Burkett and produced a commission from his excellency Governor A.V. Brown, Commissioning him a Justice of the peace in the 2nd district of Benton County.  Also a Commission from A.V. Brown, Governor of Tennessee commissioning Evans Jordan, a Justice of the peace in the first Civil district of Benton County both of whom appeared in open Court and took oath to support the Constitution of the United States and of the State of Tennessee, an oath against dueling and the oath of office.

The Court then proceeded to elect a quorum to hold the quorm Courts the present year.  Whereupon the following Justices were elected (to wit) E. Perkins, J.K. Thomas and Nathan Williams.

Personally appeared in open Court Mary Ann Marchbanks, who was this day chosen and appointed guardian of Cammelia and Parlee Marchbanks, Minorsand together with her Abil Utley her security who appeared in open Court and entered into and acknowledged the due execution of their bond in the penal sum of Two hundred & forty dollars conditioned as the law directs.

January Term 1846

On Motion it is ordered by the Court that Hugh M. Brown be appointed overseer of the road to work from the Town of Camden to the ford of the branch near the 2 Mile tree and the following hands shall work under said Brown (to wit) James Presson, Joseph Wiseman, John Capps, Noah Strickland, Berry Cowell, Edward Cowell, Charles Cowell, Thomas Jones & hands, John B. Bridges, Wyly Smith, Thomas A. Presson, James F. Presson and all other hands in the bounds shall work under said Brown on said road which is established in the 1st Class.

Issued January 6th.

The Court then proceeded to elect Revenue Commissioners to settle with the Clerk and Trustee of Benton County for the present year.  Whereupon the following Justices were appointed to wit, Nathan Williams and Geo. W. Farmer.

The Court then proceeded to elect a tax Collector for Benton County for the year 1846, and there being present & presiding on the bench a majority of all the Justices in Benton County and all voting, upon counting the votes, it appears that David Brewer is duly elected Collector of the public & county taxes for the present year.

On Motion it is ordered by the Court that J.C. Latimer, Jesse Raspberry, J.M. Browning, J.T. Florence, John Morris, David Morris, Lewis W. Brewer be appointed a jury of Review to view and Mark an alteration in the road leading from Willis Rushing to intersect the Wyatt’s Mill road near Jesse Raspberry and Make report to the Next term of this Court.

Issued Jan. 6th.

Personally appeared in open Court M.M. Vickers and Elizabeth Barnes Administrator and Administratrix of the estate of Charles Barnes deceased and returned the inventory and account of sale of the property of said estate and oath being Made to the same.  It is therefore ordered by the Court to be recorded.

On Motion it is ordered by the Court that Willis Rushing be released from the payment of $1.50 cents it being the amount of County tax upon a tract of land which was listed in Two districts and that the Sheriff have a credit for the same in his next settlement with the Trustee of Benton County.

January Term 1846

On Motion it is ordered by the Court that James Sherly be appointed overseer of the road to work from James Wyly’s to said Sherly’s.  Hands as follows; Charles Dalton, Berry Dalton, Mrs. Campman, Elisha Tedder and all other hands in the bounds shall work under said Sherly on said road which is established in the 2nd Class.

 Issued January 6th.

On Motion it is ordered by the Court that William Hartly be appointed overseer of the road to work from James Sherly’s to Hatly’s Branch, ands as follows:  Edward Hartly, Green Hatly, Charles Oatsvall, Franklin Smith, Stanford Hatly, Edward Hatly Sr., Harvy Dancer, James F. Dancer and all other hands in the bounds shall work under said Hatly on said road which is established in the 2nd Class.

Issued.

The Court then proceeded to Make an appropriation to E. Perkins for the amount of a fee paid Pavatt as attorney in a suit brought against the former Commissioner of the Town of Camden, it being Twenty dollars.  And there being present and presiding on the bench a Majority of all the Justices in Benton County and all voting in the affirmative, it is ordered by the Court that the said Perkins be allowed and paid the sum of Twenty dollars by the Trustee of Benton County out of any Money in the Treasury for general County purposes Not otherwise appropriated.

The Court then proceeded to levy a tax on all taxable property and polls in Benton County liable to taxation and there being present and presiding on the bench, D.P. Hudson, Nathan Williams, J.W. Davidson, E. Jordan, Eligah Alsop, William M. McAuley, William Barnes, E. Perkins, J.K. Thomas, Thos. R. Jett, W.H. Smally, S.H. Davidson, Geo. W. Farmer and David M. Burkett being a majority of all the Justices in said County and all voting in the affirmative, it is therefore ordered by the Court that the following tax be levied to wit:

For the payment of County contingencies:                                                                                                                     On each $100.00 worth of taxable property                     cents                                                              On each poll                                                                                         12½ cents
And for the payment of Jurors                                                                                                                                          On each $100.00 worth of taxable property                     cents                                                              On each poll                                                                                         12½ cents
And for the payment of paupers -                                                                                                                                      On each $100.00 worth of taxable property                     cents                                                              On each poll                                                                                         12½ cents
And for the building of a Jail                                                                                                                                            On each $100.00 worth of taxable property                     cents                                                              On each poll                                                                                         50    cents
And on each Merchant or Peddlers’ licenses                                            5.00
And on each Stallion or Jack the seasons’ price of one mare and a half.

January Term 1846

Timothy Reaves and others who was appointed at a former term of this Court to open a mill road leading to S.V. Adams Mill Made report to this Court that said road had been opened according to the order of the Court.

The Court then proceeded to Make an appropriation to the Justices who held the quorum Courts for the year 1845.  And there being present and presiding on the bench a Majority of all the Justices in Benton County and all voting in the affirmative, it is, ordered by the Court that said Justices be allowed and paid the sum of 50 cents per day for each day’s services as such quorum by the Trustee of said County out of any money in the Treasury for general County purposes not otherwise appropriated.

Issued to Thomas, Farmer, Hudson, Perkins, Davidson, none others entitled.                             January 17th 1846.

Personally appeared in open Court Lewis Lashlee who was this day chosen and appointed guardian for Burrel Lashlee, a Minor and together with him Anderson Lashlee and Seth Utley his securities who appeared in open Court and acknowledged the execution of their bond in the penal sum of Three hundred dollars conditioned as the law directs.
