August Term 1846

 

State of Tennessee, Benton County, August Term 1846

At a County Court began and held for the County of Benton at the Courthouse in the Town of Camden on the first Monday in August.  It being the third day of said Month in the year of our Lord eighteen hundred & forty six and the 71st year of American Independence, there being present and presiding on the bench worshipfuls, Esqrs, (to wit); E. Perkins, Nathan Williams, J.K. Thomas.

The Clerk of this Court presented a settlement Made with Presley Thornton guardian of Eliza Harrison which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Amos Bruce guardian of the Minor heirs of Burrel Lashlee deceased which said settlement was examined & approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Obediah Bullock, Administrator of the estate of John Nobles deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a Settlement Made with James Septo, Adminstrator of Hillary Capps, deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Sarah Hatley guardian of the Minor heirs of Hardy Hatley deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with J.D. Rushing guardian of Septa A. Murray which said Settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with James M. Camp, executor of the last will and testament of George Camp deceased which said settlement was examined and approved by the Court and ordered to be recorded.

August Term 1846.

The Clerk of this Court presented a settlement Made with Wm. J. Greer, Administrator of Jas. C. Melton, deceased which said settlement was examined and approved by the Court and ordered to be recorded.

On Motion it is ordered by the Court that Moses Taylor be appointed overseer of the Perryville Road to work from the Kirkman’s ferry road to Birdsong’s, hands as follows; Alfred Burn, William Burn, Reubin Mitchell, James Marchbanks, Kinchen Taylor, Samuel Davidson, Jr., Stephen Marchbanks, Richard Thomason and all other hands in the bounds shall work under said Taylor on said road which is established in the 2nd Class.

Issued Aug. 4th.

Personally appeared in open Court John C. McDaniel and produced a Commission from his excellency Aron V. Brown, Governor of Tennessee Commissioning him a Justice of the peace in the 1st Civil District of Benton County.  Whereupon the said John C. McDaniel took an oath to support the Constitution of the United States & of the State of Tennessee, an oath against dueling & the oath of office.

On Motion it is ordered by the Court that Daniel Graham be appointed overseer of the road to work from Sugar Creek to the of the Ridge South of Esqr Wright’s, hands as follows; Edward Lindsey’s hands, Lauflin Beaton, Malcom Beaton, John West, M. Mannon, S. Clement and all other hands in the bounds shall work under said Graham on said road which is established in the 2nd Class.

Issued Aug. 4th.

On Motion it is ordered by the Court that Jackson Farmer be appointed overseer of the road to work from Pridgen Melton’s to the top of the Ridge between Harmon’s and Beaverdam Creek, hands as follows; William Pafford, David Pafford, Thomas Pafford, David Patterson, James Pafford, David Y. Vester, Abram Ballowe, Pridgen Melton, Wiley Whitley, Joseph Melton, John W. Melton and all other hands in the bounds shall work under said Farmer on said road which is established in the 2nd Class.

August Term 1846

On Motion it is ordered by the Court that James Lockhart be appointed overseer of the road to work from Esqr. Floyd’s to this end of the old Levy in Sandy Bottom, hands as follows; Robert Jones, Hiram Pearce, William Clack, Cullen French, Hugh Alsop, David Alsop, John Ragdale, D.N. Shilling, William Barnes, Zechariah Childers, John Lowery, Eligah Lowery, William Warmack and all other hands in the bounds shall work under said Lockhart on said road which is established in the 2nd Class.

Issued Aug. 6th.

Personally appeared in open Court Zecheriah Childers, Administrator of the estate of James Colier deceased and returned a second sale bill of the property of said estate and oath being Made to the same it is ordered by the Court to be recorded.

On Motion it is ordered by the Court that Francis Whittington be appointed overseer of the road to work from the forks of the road near Eliza Walker’s to the forks of the road near the widow Matlock’s, hands as follows; William Allison, Squire Bishop, John Hignite, Thomas White, Mansfield Massey and all other hands in the bounds shall work under said Whittington on said road which is established in the 3rd Class.

On Motion it is ordered by the Court that John M. Petty be appointed overseer of the road to work from Kirkman’s ferry to the stage road, hands as follows; John Russel, James Russell, William Cole, Stephen Boswell, E.F. Wills and hands, Warren Sayles, Hall Nivins, Uriah Phifer & hands, Booker Nivins, Isaac Nivens, Benjamin Burton, John Thornton and all other hands in the bounds shall work under said John M. Petty on said road which is established in the 2nd Class.

Issued Aug. 6th.

Court then adjourned until Tuesday morning 9 o’clock.

August Term 1846

On yesterday being for the purpose of giving Jacob A. Browning guardian of J.A. Bomer further time to give bond and security as the law requires said Browning appeared in open Court and asked leave of the Court for further time to give bond as aforesaid.  Whereupon it is ordered by the Court that said Browning be allowed until Wednesday to give said bond as aforesaid.

On Motion of Samuel Madden it is ordered by the Court that the following persons act as Jury of Review to view and Mark an alteration in the road leading from the Town of Camden to Davidson’s Ferry, beginning at the Town of Camden and running the nearest best way so as to intersect the old road between C.M. Sarrett and Samuel Madden (to wit) Daniel F. McElyea, R.N. Wood, Wm. K. Perkins, E. Arnold, James, Arnold and Furnandas Arnold and that they Make report to the next term of this Court.

Wednesday Morning ten o’clock August 5th 1846.

Court met according to adjournment, present and presiding the worshipfuls, Esqrs. (to wit) E. Perkins, J.K. Thomas and D.P. Hudson.

John W. Utley, Dep. Sheriff returned into Court a Notice executed on Jacob A. Browning guardian of Jacob A. Bomer Notifying the said Browning to appear and give other security and release them and it appearing to the satisfaction of the Court that a copy of said Notice had been given to the said Browning for more than ten days previous to the setting of this Court and it appearing to the Court that Pleasant Mullinix and John F. Johnston were the securities of the said Browning.  It is therefore ordered by the Court that the said Pleasant Mullinix and John F. Johnston be released from any further liability on said bond.

August Term 1846

Thereupon the said Jacob A. Browning appeared in open Court and surrendered the guardianship of said Minor.

Personally appeared in open Court Calvin Bomer who was this day chosen and appointed guardian of Jacob A. Bomer and together with him Solomon M. Atchison and A.F. Benton his securites who appeared in open Court and entered into and acknowledged the due execution of their bond in the penal sum of Nine hundred dollars conditioned as the law directs.

Court then adjourned until Court in Course.

State of Tennessee.

Know all men by these presents that we W.P. Morris and Amos Bruce all of the County of Benton are held and firmly bound unto Aron V. Brown, Governor of the State of Tennessee and his successors in office in the penal sum of One thousand dollars for the payment of which well and truly to be Made we bind ourselves, our heirs and representatives, jointly and severally firmly by these presents, sealed with our seals and dated this the 2nd day of February 1846.

The condition of the above obligation is such that whereas by an Act of the Legislature of the State of Tennessee passed the 23rd day of January 1846, licensing Tipling houses, it is Made the duty of the several clerks of the County Courts in this State to Collect the amount of Revenue that May arise and be due thereon.

Now if the said Wm. P. Morris shall account for and pay over the Money by him collected under the said Act to the State, County or Town and also well and faithfully discharge and perform all
