August Term 1844

 

State of Tennessee, Benton County, August Term 1844

At a County Court begun & held for the County of Benton at the Courthouse in the Town of Camden on the first Monday in August it being the 5th day of said Month in the year of our Lord eighteen hundred & forty four and 69th year of American Independence there being present and presiding on the bench the worshipfuls, Esqrs. (Viz) D.P. Hudson, E. Perkins and David W. Benton.

Personally appeared in open Court Wyatt Arnold and produced a commission from his Excellency James C. Jones Governor &c Commissioning him the said Wyatt Arnold a justice of the peace for Benton County Whereupon the said Wyatt Arnol took an oath to support the Constitution of the United States and also the State of Tennessee, an oath against dueling and also the oath of office whereupon the said Wyatt Arnold took his seat upon the bench.

The Clerk of this Court presented a settlement Made with R.C. Petty and John M. Petty executors of the estate of Thomas Petty deceased which said settlement was examined & approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Presly Thorington Guardian of Eliza Ann Harrison which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Sarah Hatley guardian of the Minor heirs of Hardy Hatley deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Redden Hollowell guardian which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Jane Pippin Administratrix of the estate of John Pippin deceased which said settlement was examined, approved & ordered to be recorded.

August Term 1844

The Clerk of this Court presented a settlement Made with Amos Bruce guardian of the Minor heirs of Burrell Lashlee deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Alexander McRae quardian of the Minor heirs of Mathew Melton Deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with John D. Rushing guardian of Sytha Ann Murray which said settlement was examined and approved by the Court and ordered to be recorded.

On Motion and it appearing to the satisfaction of the Court by affidavit of Lewis Hyre that a certain stray sorrel horse by him strayed about 1st of July 1843 Died in the first week of May last as he has been informed by his family while he was absent from home and that in a few days after his return home he was taken sick and unable to Make the proper affidavit before the time expired it is therefore ordered by the Court that the said Hyre be released from the payment of the valuation of said horse and that a copy of this order be certified by the Clerk of this Court to the ranger accordingly.

David W. Benton, Willis Rushing and David Morris Commissioners who were appointed at a former term of this Court to lay off and set apart a year’s provisions for the wido & family of George Bell deceased Made report to this Court which was examined & approved by the Court and ordered to be recorded.

August Term 1844

On Motion it is ordered by the Court that Jon W. Melton be appointed overseer of the Wyatt’s Mill road to work from Sion Melton’s lane to the Sulphur Creed road near the Sulphur Springs and the following hands shall work on said road (viz) Sion Melton, Conrod Melton, Willie Walker and Etheldred Melton shall work under said Melton on said road which is established in the 3rd Class.

Issued 7th August.

On Motion it is ordered by the Court that William Parker be appointed overseer of the Harmon’s Creek road to work from Daniel Benton to David W. Burton’s hands as follows: W.W. Holland, William C. Benton, J.B. Winchester, James b. Hill, John P. Benton, Perry Melton, James J. Farmer, Jesse Bates, William Berry & Calvin Parker shall work under William Parker on said road which is established in the 2nd Class.

Personally appeared in open Court Amos Bruce Trustee of Benton County and together with him Jesse Hammonds and C.K. Wyly his securities who appeared in open Court and acknowledged the due execution of their bond for the purpose of drawing the common school fund from the Treasurer of the State in the penal sum of Nineteen hundred dollars conditioned as the law directs.

On Motion it is ordered by the Court Daniel Holland, Vincent Horn, Zepheniah Collins, Henry Durdin and Wilson M. Sarrett be appointed a jury of Review to view and examine the road from the mouth of C.M. Sarrett’s land to the Cross road between said Sarrett’s and S. Madden’s and also the new cut way and that they report at the next term of this Court which of the two ways will be the most advantageous as a highway to the public and to individuals.

August Term 1844

On Motion of William M. Malin and William Mothershead who Made oath according to law and together with Malichi Harrison and Seth Utley their security appeared in open court and entered into and acknowledged their bond in the penal sum of two thousand dollars conditioned as the law directs.

It is ordered by the Court that the said William M. Malin and William Mothershead have letters of administration upon the estate of William Malin deceased to be Made out in due form of law when required.

On Motion it is ordered by the Court that John Beard, Malachi Harrison and Pleasant Mullinicks be appointed commissioners to lay off and set apart a suffiency of provisions to serve the widow and family of William Malin, deceased one year and that they make report of the same to the next term of this Court.

Issued 7th August

Alexander McRae guardian of the Minor heirs of Methew Melton deceased together with Sion Melton, Thomas Jones and William J Greer appeared in open Court and entered into and acknowledged their bond in the sum of Two Thousand dollars conditioned for the faithful performance of his said guardianship of said Minors as the law directs.
