April Term 1845

D.W. Benton and Thomas R. Jett.  It is therefore ordered by the Court that Eleven dollars & 60 cents be allowed and paid to the said Whitte & Cashion by the Trustee of Benton County out of any money in the Treasury for general County purposes not otherwise appropriated.

Issued April 26th.

On Motion it is ordered by the Court that the Sheriff proceed forthwith to bring Thomas McPeters a Minor orphan into Court immediately.

On Motion of John Hignite who Made oath according to law and together with him Lemuel Buchanan and Hilliary Crabb his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Eight hundred dollars conditioned as the law directs.  Whereupon it is ordered by the Court that he have letters of Administration upon the estate of Peter Hignite deceased to be Made out in due form of law when required.

On motion of B. Beard who Made oath according to law and together with him P. Mullinix and N. Nunnery his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Three thousand dollars conditioned as the law directs.  It is therefore ordered by the Court that he have letters of administration upon the estate of James Beard deceased to be Made out in due form of law when required.

The Court then preceeded to Make an appropriation to Williams McGee a pauper of said County and there being present and presiding on the bench a Majority of all the Justices in Benton County and there being two sums in Nomination12 & 25 dollars and the vote being taken, it appears that the sum of Twelve Dollars is adopted.  It is therefore ordered by the Court that the sum of Twelve dollars be allowed & paid to John Smalley for the use of said McGee by the Trustee of Benton County out of any money in the Treasury for the payment of paupers not otherwise appropriated.

April Term 1845

On Motion it is ordered by the Court that E.W. Sayles one of the executors of the estate of James S. Sayles deceased be released and that he be no longer liable upon his bond as such.

The Court then proceeded to make an appropriation to John F. Johnson for services he rendered as a commissioner of the Town of Camden and there being present and presiding on the bench a Majority of all the Justices in Benton County and all voting in the affirmative.  It is therefore ordered by the Court that the said Johnson be allowed and paid the sun of any money in the Treasury for general County purposes not otherwise appropriated.

Issued July 19th.

The Court then proceeded to appoint Trustees for Benton County Academy.  Whereupon the following persons were appointed to serve until the next term of Court (viz.) Thomas R. Jett, E.F. Wills, M.L. Travis, Anderson Lashlee and James Gordon, said Trustees appeard and entered into bond as the law directs.

Esqr. J.R. Mathis returned into Court the bond of Martha Ann Malin, James Harrison and James E. Merick her securities, conditioned that a baseborned child of said Martha Ann Malin shall not become a charge upon Benton County which was ordered to be filed in the office of the Clerk of this Court.

On Motion it is ordered by the Court that C.M. Serratt be appointed overseer of the stage road to work from the Town of Camden to Burnside Creek, hands as follows; Daniel Holland, B. Hardy, Zephemiah Collins, A.R. Carnes and all other hands in the bounds shall work under the said Serratt on said road which is established in the 1st Class.

April Term 1845

On Motion it is ordered by the Court that Jeremiah Perry be appointed overseer of the road to work from P. Mullinix’s to Unionville.  Hands as follows; Jesse Dillion, John Gossett, Dozier Temple, Amos Bruce, hands Henry Gossett, James Hamp and hands, all other hands in the bounds shall work under said Perry on said road which is established in the 2nd Class.

Issued 9th April.

On Motion it is ordered by the Court that Alfred Tippitt be appointed overseer of the road to work from the forks of the road North of Wm. Hubbs to Perry County line, hands as follows: Charles Duncan, Whitfield Tippett, James Walker, Armisted Walker, Richard Walker, Andrews Fulks and all other hands in the bounds shall work under said Tippett on said road which is established in the 2nd Class.

Issued 9th April.

On Motion it is ordered by the Court that James Sherly be appointed overseer of the road to work from James Wyly’s to the forks of the road at Hatley's Branch, hands as follows; all the hands that worked under R.F. Mullinix or in the bounds shall now work under the said Sherly on said road which is established in the 2nd Class.

The Court then proceeded to Make an appropriation to W.W. Lashlee for enclosing the Courthouse and there being present and presiding on the bench a Majority of all the Justices in Benton County and all voting in the affirmative except J.D. Rushing and G.W. Farmer who voted in the Negative.  It is therefore ordered by the Court that the sum of Seventy two dollars be allowed and paid to said Lashlee by the Trustee of Benton County forthwith without regard to other claims filed out of any money in the Treasury for general County purposes Not otherwise appropriated.

The Court hereby appointed A. Lashlee, J.R. Thomas and Joseph Wiseman to review said work when done and report to the Clerk of this Court before the order is issued.

April Term 1845.

The Clerk then proceeded to Make an appropriation to David Brewer sheriff for Ex Officio services and there being present and presiding on the bench a Majority of all the Justices in Benton County and all voting in the affirmative.  It is therefore ordered by the Court that the sum of Twenty five dollars be allowed & paid by the Trustee of Benton County out of any Money in the Treasury for general purposes not otherwise appropriated.

The Court then proceeded to Make an appropriation to the Revenue Commissioners for taking a list of taxable property & polls in said County for the year 1845 and there being present and presiding on the bench a Majority of all the Justices in Benton County and all voting in the affirmative.  It is therefore ordered by the Court that the sum of two dollars & fifty cents be allowed and paid to said Review Commissioners who are as follows.

The Clerk of this Court presented a settlement Made with Meriah McDaniel, Administratrix of the estate of Thomas Cheatham deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with James Camp one of the executors of the last will and testament of George Camp, deceased which settlement was examined and approved by the Court and ordered to be recorded.

Personally appeared in open Court Jane Sayles executor of the last will and testament of James S. Sayles deceased and returned a sale bill of the property of said estate and oath being Made to the same it is ordered to be recorded.

April Term 1845.

On Motion it is ordered by the Court that Mark Hatley, Wright Jordan and Ansil Pearce work under James Holland in addition to his former hands.

One of the Jurors of Review that was appointed at a former term of this Court to view and Mark an alteration in the road leading to Wynn's ferry Made report to this Court that they had estate listed, said alteration as paid for in the petition.  Whereupon it is ordered by the Court that said alteration be Made and established a highway of this County.

Personally appeared in open Court David Brewer, Sheriff and together with him Seth Utley, W.A. Steele, W.D, Wiseman and Cullen Nowell his securities who appeared in open Court and entertained and acknowledged their bond which are as follows (viz.)

State of Tennessee

Know all men by these presents that we David Brewer, Seth Utley, Wm. A. Steele, W.D. Wiseman and C. Nowell att. of the County of Benton, are held and firmly bound unto D.P. Hudson, Chairman of the County Court of Benton County and his successors in office in the penal sum of Two thousand dollars the payment of which well and truly to be Made, we bind ourselves, our heirs & representatives jointly & severally, firmly by these presents sealed with our seals and dated this the 7th day of April 1845.

The condition of the above obligation is such that whereas the above bound David Brewer was on the first Saturday in March 1844 duly and lawfully elected Sheriff & Collector of the public and County Taxes in and for the County of Benton by the qualified voters thereof for the term of two years next ensuing.  Now if the said David Brewer shall well and truly collect all county taxes and revenue within said county which by law he ought to collect and shall well and truly account for and pay over to the County Trustee of said County of Benton all County Taxes and revenue by him collected as should have been collected on or before the first day of December 1845 then this obligation to be void otherwise to remain in full force and effect from the date above.

April Term 1845
State of Tennessee

Know all men by these presents that we David Brewer, S. Utley, W.A, Steel, W.D. Wiseman and C. Nowell, All of the County of Benton are held and firmly bound unto James C. Jones, Governor of the State of Tennessee and his successors in office in the penal sum of six hundred dollars the payment of which well and truly to be Made we bind ourselves, our heirs & representatives, jointly & severally, firmly by these presents sealed with our Seals and dated this the 7th day of April 1845.

The condition of the above obligation is such that whereas the above bound David Brewer was on the first Saturday in March 1844 duly and lawfully elected Sheriff and Collector of the public taxes in and for the County of Benton by the qualified voters thereof for the term of two years next ensuing.

Now if the said David Brewer shall well and truly collect all State taxes and also all taxes on school lands within said County which by law he ought to collect and shall truly account for and pay over all taxes by him collected or which ought to have been collected by him as such Sheriff & collector as aforesaid on or before the first day of December in the year 1845 to the Treasurer of the State.  Then this obligation to be Null and of No effect, otherwise to remain in full force and effect from the date above.
