         For the love and affection I entertain for my son Bolivar Payne, I do freely give transfer and convey to him my tract of land in Robertson County Tennessee District No.1, containing by estimation one hundred & fifty acres and bounded as follows, to wit, Beginning on a black oak sixty or eighty yards South of Pleasant Wright’s Spring, running North 173 poles to Wesley Gernegan’s line, thence West 203 poles to Solomon Payne’s corner old survey, thence 123 to a black jack, thence East 203 poles to the Beginning. To have and to hold to the said Bolivar Payne his heirs and assigns forever. I do covenant and agree for myself and heirs to Warrant and defend the title to the said tract of land to the said Bolivar, and his heirs forever against the lawful claims of all persons whatever, With the following conditions to wit. That if I die possessed of an estate sufficient to make all my children equal with the said Bolivar’s share here given, then this deed to remain in full force, & if otherwise the said Bolivar to refund until all are equal, this July 6th 1850. Received 2 Aug 1853 at 12 Ock PM.

State of Tennessee Robertson County
         Personally appeared before me Robt C. Murphey clk of the County Court for said County B.F. Payne on the 23 of Sept 1852 and Thomas J. Payne on the 23 of April 1853, the subscribing witnesses to the within deed, who being first sworn dispose and say that they are acquainted with Solomon Payne the bargainor to the within deed, and that he acknowledged the same in their prescence to be his act and deed for the purposes therein contained on or about the day it been (?) date. Witness my hand at office the 23 of April 1853.
