         Whereas we the undersigned Francis McMurry and Thos McMurry of the one part and our Father Robert McMurry of the other part did enter unto a written document or agreement on the 13th day of February 1867 which was duly acknowledged and recorded in the regisistors office of Robertson County Tennessee in Book No 13 Page 446 to which reference can be had for a full and accurate Statement of Terms by and between all the parties aforesaid and whereas we are desirous of annulling undoing and revoking and said agreement in total. Therefore we the undersigned do each for ourselves agree to and in the other that said covenant or agreement made and entered by and between us as aforesaid Shall be set aside and for nothing held and that each and all of us shall be released from any and all liability upon account of said covenant or agreement and that the same shall have no more force nor effect than if the cause had never been made.
In testimony whereof we have hereunto subscribed our names this the 13th day of August 1870.

         Personally appeared before me R K Mulloy Clerk of the County Court of said County the within Robert McMurry ??? Francis McMurry and Thos McMurry the bargainers with whom I am personally acquainted and who acknowledged that they executed the annexed instruments for the purposes therein contained.
