         I John Payne of Sumner County and State of Tennessee have this day bargained and soled and do hereby transfer and convey unto Warren L. Payne of Robertson County and State aforesaid and his heirs forever for the consideration of one hundred dollars in hand paid a tract of land in the State of Tennessee Robertson County and District No. 1 containing by estimation one hundred and fourteen acres and 66 poles be the same more or less and bounded as follows:
         Beginning in Bomans north boundary line on the branch near the beginning corner of a sixty acre survey of W. L. Payne's an a Spanish oak running South two hundred and twenty six poles to a black oak and hickory, thence East eighty one poles to a black Oak thence north two hundred and twenty six poles to a black Jack, thence West eighty one poles to the Beginning. To have and to hold the same to the said Warren L. Payne his heirs and assigns forever, I do covenant with the said Warren L. Payne that I am lawfully seized of said land have a good right to convey it and that the same is unencumbered, I do further covenant and bind my self my heirs and representatives to warrant and forever defend the title to the said land and every part thereof to the said W. L. Payne his heirs and assigns forever against the lawful claims of all persons whatever. This 9th day of September 1839.

         State of Tennessee Robertson County: Personally appeared before me Joseph E. Winfield clk of the County Court for the County aforesaid on the 6 of Oct S. H. Turner and on the 8th of Oct Andrew West both subscribing witnesses to the within deed, first sworn depose and say that they were personally acquainted with John Payne the bargainer in the foregoing deed and that he acknowledged in their presence on the day that it bears date that he executed the same for the purposes therein mentioned, given under my hand at office 9th day of October 1840.
