LAST WILL AND TESTAMENT
OF
W. W. PAYNE DECEASED
In the name of God, Amen, I, W.W. Payne of Portland RFD number 1 in of Robertson County, Tennessee, being of sound mind and memory, and considering the uncertainty of this frail and transitory life, do ordain and make publish and declare this my last will and Testament, that is to say:
First, After all my lawful debts are paid and discharged, I give and bequeath to my wife, Alice V. Payne my home farm containing about 325 acres together with the buildings and all the household goods belonging to us also a wagon a team, and buggy and horse, two milk cows and ten head of hogs. Also the farming tools on hand. Also in addition to the above two thousand five hundred ($2500.00) dollars in cash. At her death the farm is to be sold on one and two years time and the proceeds are to be distributed equally among my seven children.
Secondly, To my Son David A. I give the farm known as Cummings and Stringer Land.
Third. To my daughter Tryphenia McGlothlin I give a farm in Sumner County, Tennessee, known as the Armstrong land. I add to the said tract of land the sum of five hundred dollars to be paid from the money from the sale of my personal property.
Fourth. To my Son Joe B. I have given the Bradley tract and part of the Swan tract.
Fifth. To my Son Rueben D. I have given one hundred and forty acres on the north end of the Tom Wright farm.
Sixth. To my daughter Forrest Richards I have given money to the amount of twenty-five hundred dollars to pay for the Richards land. I add to this amount two hundred ($200.00) dollars to be paid from the effects of my personal property.
Seventh. To my sons Benton and Allison W. I give the Woodall farm to be divided equally in the number of acres. Benton to have all the south side of Summers Branch and enough from the west and across the branch to make the number of acres equal to Allison’s.
Eight. The remainder of my real estates including two lots in Drakes addition to Orlinda, Tennessee and the reminder of the Tom Wright farm and the Bayless Farm are to be sold on one and two years time bearing interest from day of sale.
Ninth. In addition to the home farm with buildings, tools, team, horse and buggy and ten hogs and twenty five hundred dollars in money I direct that my executor hold the seven shares of stock held in the Bank of Orlinda and the dividends to be paid to my wife Alice V. Payne during her natural life.
Tenth, all the residue of my property including perishable articles, notes, stocks, insurance money shall be equally divided among my legal heirs. Personal property to be sold on the twelve months time with interest from date of sale where the amount is $10 or more. Likewise I hereby make and appointing my son David A. Payne and my son-in-law W. H. Glothlin my executors, without bond, of this my last will and testament.

In witness where of I have subscribed my name this 7th day of January in the year of our Lord one thousand nine hundred and fourteen.
The above written instrument was subscribed to by the said W.W. Payne in our presence and acknowledged by him to each of us and he at the same time declared the above instrument so subscribed to be his last will and Testament: and we at his request have signed our names as witness hereto, in his presence and in the presence of each other and written opposite our names of respective places of residence.

The foregoing will was produced in open court for probate and there upon came W. W. Gilbert and H. W. McNeely subscribing witness there to by whom said will was duly proven.
Thereupon the court ordered the said will recorded as the last will and testament of W. W. Payne deceased.
