         I John Summerville of the County of Robertson and State of Tennessee being in bad health though of sound mind do make this my last Will and Testament in the following manner, to wit: I wish all my just debts paid out of my effects, the balance of my property remaining I give and bequeath unto my loving wife Phoebe Summerville during her widowhood at the expiration of which I wish all my property and effects sold and equally divided between my children, Joseph, William, Milly, John, Hollin, James, Marcus, Elizabeth, Solomon, Philip and Dixon Summerville, I give and bequeath unto my son William forty acres of land lying north of the branch known by the name of the Hutty tract extra the balance of my land I give and bequeath to my wife Phebe Summerville during her natural life time or widowhood at the expiration of either of which I wish it sold and equally divided amongst my children as aforementioned in testimony whereof I have hereunto set my hand and seal this 11th day of January in the year of our Lord one thousand eight hundred and thirty five and do hereby appoint William Summerville my executor to this my last will.

         In the foregoing last Will and Testament of John Summerville, deceased, was presented in Court for Probate and thereupon came Warren C. Richmond and Daniel Mulloy subscribing witnesses thereto who being first sworn, depose and say that they were personally acquainted with John Summerville the testator that he acknowledged the foregoing in their presence upon the day it bears date to be his last will and testament, that they witnessed the same at his request and that he was in his proper mind, which is ordered to be recorded.
