State of Tennessee, Robertson County, District No. 11.
         The following are the Boundaries of the Land John Gilbert Dec’d & seized and possesed of. Beginning on a walnut W. Brooks corner in a hollow, runs South 86 2/5 W 48 poles to a stone, thence S 89 ¾ W crossing a creek at 160 poles in all 190 poles to a white oak John Ellisons corner, thence S 144 ½ poles to a stake of Covington’s corner, thence S 89 ¾ E 176 poles to a stake & pointes in the line of the Church line, thence N 25 E 31 poles to a rock, thence S 75 E 6 poles to a stake near a church, thence N 6 W 35 poles to a red bud, thence E 10 poles to a fallen walnut tree, thencd N 27 E crossing a creek at the mouth of a spring branch and containing in all 26 poles, thence N 5 E 8 poles, thence N 45 E 34 poles, N 18 E 12 poles to a hickory, thene N 10 W 20 poles to the beginning, containing 176 acres after substracting 10 acres that Treadway has within the above platt surveyed January 8th 1858.

         I sold the land on a credit of one & two years taking bond and two good securities. The negroes I sold on a credit of 12 months taking bond and two good securities. A lien was obtained on the land as directed in the decree & sold subject to the widows Admintr. By said survey said land contains 176 acres and was struck off to Thomas H. Gilbert at the price $2,064. That being the highest and best bid for the same and he paid in cash $64.00 and securities his notes at one and two years for $1000 each with J.W. Gilbert & S. Gilbert his securities. Mrs. Mary Gilbert became the purchaser of negro slave Cyrus at the price of $1000.00 as she executed her note for the land due at 12 months with S. Gilbert & J.W. Gilbert her securities. J.W. Gilbert, S. Gilbert, Ann Parks & D.W. Jernigan became the purchaser of woman Susan & child at the price $1500.00. They paid in cash $25 and executed their note for $1475.00 due in one year with Isham Treadaway & T.H. Gilbert their securities. But Thomas H. Gilbert is to take Susan’s child at the price of $250.00 to be paid to the purchasers of Susan and the title is to be decreed in him by agreement of the parties. Samuel Gilbert became the purchaser of slave Van Buren at the price of $1800.00. He paid in cash $50.00, and executed his note for $1250.00 due at 12 months with J.W. Gilbert & Guinn Parks his securities. Ann Parks became the purchaser of girl Malicia at the price of $250.00. She was to have paid in cash $15.00 but failed to do so for which I ask a decree of the court . She executed her note for $435.00 with S. Gilbert her security, leaving a balance of $15.00 on said slave yet unpaid. E. Toliver became the purchaser of woman Charlot at the price of $279.00 as he paid in cash $10.00 and executed his note at 1 year $269.00 with Wm. Armstrong & R.C. Tate his securities.

All of which is respectfully submitted to the Hon. Court April 20th 1858

         In the same cause I have taken the proof of Love Esq & L. Peppin Esqr as to the fee of Col. Jno. E. James Sub in cause and they state that $100.00 is a reasonable fee for the services in this cause which I allow him.

Isham Treadaway & wife Louisa has been advanced Slave Harriett at the price of $1240.00
J.W. Gilbert has been advanced John Wesley valued at $1225.00
D.W. Jernigan & wife Mary, slave Martha valued at $625.00

All of which is most respectfully submitted to the Hon. Court May 29th 1858

         And said report being unexcepted to it in all things confirmed and it is ordered, adjudged and decreed by the court that the title to the Tract of land in said report named be vested in _______ Mary Gilbert for and during the full term of her natural life and that she pay the costs of said assignment of dower for which let her fee issue.
         And this cause this day came on for further hearing on the report of he Master as to the sale of the land & negroes and adminisments which report is in the following words & figures. To wit.

The Hon. Chancery Court
         We the undersigned Commissioners being appointed by the Hon. Chancery Court at its December Term 1857 to set apart to Mrs. Mary Gilbert Dower out of the real estate of John Gilbert Dec’d. We being duly sworn have proceeded to set apart to her as Dower a tract or small parcel of land lying in the 11th Civil District of Robertson County, Tenn, Butted & Bounded as follows, to Wit: Beginning at a stake in the middle of the brance below the house where the widow now lives, runs N 33 E 78 poles to a hickory in Durretts line, thence E 29 poes to a stone formerly the beginning of the old tract, Thence South 73 poles to a stake in the creek & pointers, Thence down said creek with its meandering to the beginning, including the mansion house, containing twenty one acres & forth. The following are the boundaries of the tract lying in the SW corner of the old tract: Beginning on a stake Jefferson Covingtons corner runs S 89 ¾ E 33 ½ poles to a stake on the East side of a branch, Thence down it with its meanders N 35 E 68 to a walnut Isham Treadway’s corner, thence N 21 E with Treadaways line crossing creek 16 poles to a horse barn, thence N 18 W 27 poles to a sugartreee, thence West 68 poles to a stone in Ellisons line, thence South 97 ½ poles to the beginning, containing 36 ¼ acres. Now we wish to distinctly understand that we give her the wdow the right of way from one farm to the other, which two tracts of land in our opinion constitute one third of the real estate of John Gilbert dec’d all of whidh is submitted.
Given under our hands & seal this January 8th 1858.

         And said report being unexcepted to is in all things confirmed and it is orderee, adjudged, & decreed by the Cout that the title to the land and slaves in said report named be divest out of Petitioner ad vested in the repective purchases thereof as is shown in said report, thei heirs and assigns forever retaining a lien on said land for the purchase money and that the master make deed therefor to the purchasers of the land, they paying therefor and as to the slaves that a copy of this decree be furnished for registration of desired and that petitioners Isham Treadaway & wife Louisa be charged as advancement $1240, Petitioner J.W. Gibert $1275; Petitioner D.W. Jernigan & wife $125.
         As it states in said report and it is further ordered adjudged and decreed by the court that this cause remains in court for each part orders as may be necessary or advisable.
